Amherstburg police hearing to resume

The Police Services Act hearing for an Amherstburg officer accused of assaulting a detainee continues Tuesday after a six-month hiatus.

Const. Andrew Challans faces four charges in relation to a December 2010 arrest, where Justin Brodie Timms-Fryer was allegedly roughed up after a vehicle he was a passenger in was pulled over by Challans.

Timmins-Fryer suffered head and facial injuries and had gravel embedded in his face.

Challans is charged with two counts of unlawful or unnecessary exercise of authority, discreditable conduct and discreditable conduct in using profane or abusive or insulting language or was otherwise uncivil to a member of the public.

The exercise of authority counts are for unlawful or unnecessary arrest and force.

Challans charged Timms-Fryer with assault and resisting a police officer. But on July 25, 2012, Ontario Court Justice Stephen Fuerth ruled the Crown had not proved beyond a reasonable doubt that Timms-Fryer was guilty.

Timms-Fryer is the grandson of former Amherstburg police Chief Bill Fryer.

The public hearing is scheduled for May 14 to 17 at the Amherstburg Police Service.
