Challans hearing rescheduled for September

The hearing for an Amherstburg officer charged under the Police Services Act won’t resume until September.

Lawyers in the case against Const. Andrew Challans teleconferenced Friday morning, setting aside four days – Sept. 17 to 20 – for the public hearing to continue.

Andrew Bradie is defending Challans, who is charged with two counts of unlawful or unnecessary exercise of authority and two counts of discreditable conduct arising from an incident in December 2010 where it is alleged Challans roughed up Justin Brodie Timms-Fryer, a passenger in a car pulled over by Challans.

Challans pled not guilty to the charges when he was arraigned in November 2012. He has not been suspended.

The hearing was set to resume May 14, when Bradie requested an adjournment due to “a development in the (officer’s) personal life” that precluded him from attending.

Hearing officer Terence Kelly, a retired deputy chief from the York Region Police Service, allowed the adjournment.

Timms-Fryer has not objected to rescheduling the hearing.
